Note: Only the German version of these terms and conditions applies.

Scope

The general terms and conditions (hereinafter referred to as "AGB") apply to all orders and contracts concluded via the online shop 175mm.io (hereinafter referred to as "175MM") (hereinafter referred to as "order").

175MM reserves the right to change the terms and conditions. The version of the AGB applicable at the time of the order is decisive, which cannot be unilaterally changed for this order.

Offer

The offer is aimed at natural customers with residence or legal clients based in Switzerland or Liechtenstein. Deliveries are only made to addresses in Switzerland or Liechtenstein.

The offer is valid as long as it is visible in the online shop and / or stocks last. Price and range changes are possible at any time. The illustrations shown in advertising, brochures, in the online shop etc. as well as all information on the products are used for illustration and are non-binding. The specific information on the product packaging is decisive.

Price

The prices are in Swiss Francs and include VAT.

The decisive factor is the price in the online shop at the time of the order.

Order

The presentation of the products in the online shop is not a legally binding application, but a non-binding online catalog or a non-binding invitation to customers to order the product in the online shop.

An order is considered an offer to 175MM to conclude a contract.

After the order has been submitted, the customer automatically receives a confirmation of receipt, which documents that the order has been received by 175MM. The customer can only cancel the order until it is processed by 175MM. After 175MM has started processing the order, only returns are possible, no cancellations. More detailed information can be found on the Returns policy noted.

175MM is free to refuse orders in whole or in part or cancel it in whole or in part without giving reasons. In this case, the clientele will be informed and any payments already made will be reimbursed. Further claims are excluded, in particular there is no forwarding of the non-deliverable products. Products that are temporarily unavailable cannot be reserved.

Conclusion of contract

A contract is only concluded when the order is processed by 175MM. As soon as the processing of the order has started, the customer will receive an order confirmation by email. 175MM reserves the right to cancel the contract up to the point of dispatch.

Delivery

Delivery area

The customer's delivery address must be in Switzerland or the Principality of Liechtenstein.

Delivery times

In principle, deliveries are carried out by post and orders are handed over to 175MM within 30 days if available. If the product is not available / only on queue, the delivery time can increase drastically. The available delivery options can be seen in the online shop and can be selected by the customer for each order. Delays are possible, whereby all claims for damages and other claims by customers are excluded. 

The customer assumes responsibility for the delivered products, even if they have not received them directly.

Delivery costs

The delivery costs depend on the weight and size of the ordered products. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item on the invoice.

Warranty

The guarantee takes place within the legal framework and according to the guarantee provisions of the suppliers. The choice for rework, conversion, replacement or price reduction is 175MM.

All damage caused by the customer is excluded from the warranty.

Notice of defects

If products are delivered with obvious damage to the packaging or the content, the customer must, without prejudice to their rights to defects, immediately complain to the delivery man and refuse acceptance. The customer is obliged to have a delivery confirmation from the delivery man. All transport damage must also be reported immediately to 175MM.

It is also up to the customer to check the ordered products immediately upon receipt. For any defects or deviations from the order, 175MM must be notified on the day of delivery by email [email protected] After that, only hidden defects can be claimed, which must be reported immediately after discovery 175MM.

Electronic means of payment

Payments must be made in Swiss Francs.

All accepted means of payment can be seen on the 175MM website. Customers are aware that payments with crypto currencies, PayPal & TWINT have irreversible fees and may be exposed to exchange rate fluctuations. These cannot be reimbursed under any circumstances, “as much as is left” is reimbursed.

Refunds, credits, credits

If the client is entitled to refunds or other credits, these will be credited to the client's bank transfer. 175MM decides on the repayment method. Please also note the information under "Electronic means of payment".

Severability clause

Should a provision of this contract or the content of an insert of this contract integrated into the contract be or become invalid, the effectiveness of the contract will not be affected. The contractual parties will replace the ineffective provision with an effective provision that comes as close as possible to the intended economic purpose of the invalid provision and the originally agreed contractual balance. The same also applies to any contractual gaps.

Applicable Law and Jurisdiction

Substantive Swiss law is applicable to the legal relationship between 175MM and the customer, excluding conflict of law norms and the Vienna Sales Law.
